The Rule That Healthcare AI Vendors Pretend Doesn't Exist

When a healthcare AI vendor tells you their tool is HIPAA compliant, they usually mean one thing: they'll sign a Business Associate Agreement. That's table stakes. It doesn't tell you anything about whether the tool actually handles PHI responsibly.

There's a specific HIPAA requirement that most healthcare AI tools violate without anyone noticing. It's not buried in the security rule. It's sitting in plain sight in the privacy rule at 45 CFR 164.502(b): the Minimum Necessary Standard.

What the Rule Actually Says

The Minimum Necessary Standard is direct. When a covered entity uses or discloses PHI, it must make "reasonable efforts to limit protected health information to the minimum necessary to accomplish the intended purpose."

This applies to Business Associates too. Under HHS guidance, a covered entity cannot share more PHI with a Business Associate than is needed to perform the contracted service. And the Business Associate has its own obligation to use only the PHI necessary to do its job.

The standard isn't just about individual disclosures. It applies to internal uses, requests from other entities, and — critically for our purposes — data shared with technology systems and vendors.

How AI Tools Routinely Violate This Standard

Most healthcare AI tools work by ingesting as much data as possible. The pitch is usually framed as a feature: "connect your EHR and we'll pull in everything we need automatically." The tool gets access to full patient records, then filters down to what it uses for the task at hand.

That sequence has a compliance problem. The filtering happens after the disclosure, not before it. By the time the AI system selects what it needs, it has already received far more PHI than is necessary for the intended purpose.

Take a prior authorization documentation tool. The task requires specific clinical information: the diagnosis, the severity markers, prior treatment history, and the relevant lab values. It does not require the patient's emergency contact, their billing history, their past surgical notes from ten years ago, or their mental health records. But if the tool pulls a full patient chart to extract what it needs, all of that traveled across the wire anyway.

That's not minimum necessary. That's maximum available, filtered down.

Why Vendors Don't Talk About This

The honest answer is that building to Minimum Necessary compliance is harder than signing a BAA. It requires the vendor to actually think about what data each function requires, build input collection around those specific fields, and actively refuse to accept more. That's more product work, more design work, and more constraints on future feature development.

Signing a BAA is a legal document. Designing to Minimum Necessary is an architectural decision. Vendors can check the BAA box in a few weeks of legal negotiation. Architectural compliance requires rethinking how the product ingests data from the ground up.

There's also a business incentive that cuts against it. More data means more context. More context often means better AI outputs. The optimization pressure is toward ingesting everything, not toward ingesting only what's needed.

What "Minimum Necessary" Actually Requires in Practice

HHS has published specific guidance on what the standard requires. A few key points:

Covered entities must develop policies identifying who needs access to what categories of PHI for what purposes. That same logic applies to vendor relationships — you need to be able to articulate what PHI a vendor needs and why. If you can't, you can't verify you're meeting the standard.

The standard doesn't require perfect optimization. HHS uses the phrase "reasonable efforts." A covered entity that actively considers what data a vendor needs and scopes the disclosure accordingly is in a different position than one that hands over a full data feed and calls it a day.

The standard also doesn't apply in a few specific situations — treatment purposes get more latitude, and patient-authorized disclosures operate under a different framework. But for operational tools, analytics, and AI-assisted workflows, the Minimum Necessary Standard applies.

The Evaluation Checklist for AI Vendors

When assessing whether an AI tool meets the Minimum Necessary Standard, these are the questions worth asking:

What specific data fields does the tool actually need? Ask the vendor to enumerate them. If they can't or won't, that's an answer. A tool that needs a patient's diagnosis, age, and treatment history should be able to say exactly that.

How does the tool receive data? Does it pull from a broad EHR feed, or do you input discrete data points? Broad pulls create over-disclosure risk even if the tool only uses a fraction of what it receives.

Does the tool store data it doesn't need? Receiving excess PHI is a problem. Retaining it is a bigger one. Logs, training data, and caching can turn a narrow use case into a broad storage problem.

Can the vendor demonstrate how their system limits PHI use to the task at hand? If the BAA is the only compliance answer they can offer, keep pushing.

The Irony Worth Naming

Here's the part that should give compliance officers pause: the tools most actively marketed as HIPAA-compliant healthcare AI are often the ones with the worst Minimum Necessary posture. They've invested in the BAA process, the security certifications, and the sales materials that emphasize compliance. The product architecture gets less scrutiny.

A tool that says "connect your EHR and we'll handle the rest" is describing a data architecture that almost certainly over-collects PHI. The convenience of full integration is sold as a benefit. The compliance cost of that convenience doesn't show up in the sales deck.

Meanwhile, a simple tool that collects only what it needs — and is architecturally incapable of receiving more — has a cleaner Minimum Necessary story even if it's less polished about its compliance marketing.

How Luma Approaches This

The Minimum Necessary Standard was a design constraint for Luma from the beginning, not an afterthought.

The platform collects a small, defined set of clinical inputs: the patient's age, state, diagnosis codes, disease activity markers, lab values, and prior treatment history. Those are the inputs prior authorization documentation actually requires. There are no open-ended text fields for full clinical notes. There's no EHR integration that pulls a patient's full record. The fields that exist are the fields the task needs.

Because Luma applies Safe Harbor de-identification to all inputs — meaning no names, dates of birth, or other direct identifiers enter the system — the data isn't PHI at all under HIPAA's definition. That sidesteps the Minimum Necessary obligation entirely, because the standard applies to PHI and the system never handles any.

But even setting aside the de-identification layer, the architecture reflects the underlying principle: collect what you need for the task. Nothing else.

The Standard Most Vendors Hope You Forget

The Minimum Necessary Standard isn't obscure. It's been in the Privacy Rule since 2003. HHS has published multiple rounds of guidance on it. But it rarely comes up in vendor negotiations because it requires thinking past the BAA.

Every covered entity that deploys an AI tool touching PHI is supposed to be able to answer: does this tool receive only the minimum PHI necessary to perform its function? Most organizations don't ask the question. Most vendors wouldn't give a clean answer if they did.

That gap is a compliance exposure. OCR hasn't made Minimum Necessary enforcement a headline priority the way Right of Access violations have been — but the requirement is real, the violations are widespread, and the enforcement posture is shifting toward more scrutiny of AI tool deployments specifically.

Ask the question before the investigator does.
